Purpose
To inform the industry and all holders of an export licence, of the mandatory inclusion of an Australian Federal Police National Police Check (NPC) with their application for an export licence.
Key points
Pursuant to section 14(4)(b) of the Australian Meat and Live-stock Industry (Export Licensing) Regulations 1998 (Regulations), in order for a company or individual to apply for a licence to export livestock from Australia, they are required to obtain “a criminal history check, from the Australian Federal Police, for the applicant (if an individual) and for each person in management and control of the live‑stock export business or proposed live‑stock export business”.
In addition to the above, section 21(1) of the Regulations specifies that “an application for renewal of a live-stock export licence must be made in the same way as an application for a new licence.”
Effective immediately, the department will only accept NPCs issued by the Australian Federal Police. The AFP conduct police checks based on Commonwealth legislation, whereas State or Territory checks are conducted under the State or Territory legislation and may result in incorrect or insufficient information being disclosed. As such, the department will no longer be accepting criminal history checks conducted by State or Territory Police departments.
Instructions
All applications for a livestock export licence including new, renewal or variations to existing licences (where applicable) must provide the department with a NPC issued by the AFP dated within six (6) months of their application.
