Compliance with the requirements for residue monitoring of aquaculture products under Council Directive 96/23/EC
Purpose
To provide an update of the status of various industry sectors access for aquaculture products to the European Union (EU) based on their current participation in the national EU residue program.
Background
As previously advised (refer Market Access Advice FISH09/08), a condition for market access to the EU for all farmed products, including aquaculture, is participation in a residue testing program, which meets the requirements of Council Directive 96/23/EC.
The European Commission require AQIS to ensure that only product from aquaculture farms participating in an appropriate residue program is exported to the EU.
A list of aquaculture farms currently participating in an appropriate residue program can be found in the Appendix to this advice.
AQIS registered EU approved establishments receiving product from farms participating in the EU residue monitoring program must be able to demonstrate that only eligible product is exported to the EU. To do this, establishments must ensure they implement procedures to segregate the processing and packaging of this product from product sourced from non-participating farms. These procedures, which will be audited by AQIS, should be documented in the establishments Approved Arrangement.

Appendix: Aquaculture farms eligible to export to the European Union.
The European Commission (EC) has determined that all farmed products that are exported to the European Union (EU) must be part of an EU recognised and approved residue program. The following aquaculture businesses have agreed to participate in such a program and therefore only product from these businesses is eligible to be exported to the EU from Australia.

As the industry as a whole participates in a national EU residue testing program, the following species can be sourced from any aquaculture farm within Australia:

Trout (Oncorhynchus mykiss)

- Oysters may only be sourced from those harvest areas approved for export to the EU. For further information, please contact your relevant State Australian Shellfish Quality Assurance Program Manager.
