Who does this notice affect?
This notice is relevant to all regulated entities of the Department of Agriculture, Water and the Environment.
What has changed?
The Department of Agriculture, Water and the Environment has launched a new Compliance Policy. This policy does not affect any legislative requirements the department must meet when it undertakes compliance action.
The whole-of-department policy sets out the principles we follow when carrying out our compliance activities and outlines our strategies and tools for managing non-compliance. It explains how we will approach regulated entities to achieve compliance and regulatory outcomes.
The policy demonstrates a commitment to communicating clearly and transparently with regulated entities on matters of compliance and sets out compliance as a shared responsibility. It establishes our intention to work with stakeholders, including regulated entities, to improve compliance with the legislation we administer.
The policy also outlines the principles underpinning the department’s compliance posture, including our adherence to a proportionate compliance model and focus on working with regulated entities to promote a culture of compliance. We do this by:
- setting clear objectives for the desired regulatory outcomes
- setting conditions and standards to measure compliance
- engaging with regulated entities to establish shared understanding
- building capacity to strengthen compliance
- educating regulated entities on their obligations and reduce inadvertent non-compliance
- where non-compliance is detected, applying a compliance response proportionate to the risk.
