Purpose
This Industry Advice Notice (IAN) is to advise exporters of bulk wheat that a review of the Port Terminal Access (Bulk Wheat) Code of Conduct (the Wheat Port Code) is underway.
Summary of changes and key points
- We are currently reviewing the Wheat Port Code.
- We invite stakeholders to provide feedback on the code by completing the online survey and/or making a written submission through our stakeholder engagement platform Have your Say. Submissions close on 31 January 2024.
- A discussion paper providing background information on the Wheat Port Code and questions to support stakeholders to make submissions is available on the Have your Say platform.
- Following consultation with stakeholders, we will analyse submissions provided and develop a report for the Minister. The report will include recommendations regarding the future operation of the Wheat Port Code.
Background
The Wheat Port Code regulates bulk wheat port terminal service providers to ensure bulk wheat exporters have fair and transparent access to port terminal services.
The regulation is scheduled to sunset (be automatically repealed) on 1 October 2024, unless a decision is made by government to re-make it. This review will inform the Government’s sunsetting decision and will also meet the review requirements of Section 5 of the regulations that create the code.
Section 5 of the regulations specify the matters that the review must consider, which can be broadly grouped into 3 key questions:
- What effect has the Wheat Port Code had?
- Is the Wheat Port Code still necessary?
- If it is still necessary, could the Wheat Port Code be improved?
