Purpose
This Industry Advice Notice (IAN) is to advise that amendments to the Export Control (Plants and Plant Products) Rules 2021 commenced on 1 January 2022, including requirements for third party authorised officers (AOs) to video record bulk vessel inspections.

- We have updated instructional material, forms, and systems for the commencement of the amended legislation. This content has been published on the Plant Export Operations Manual (PEOM) webpage and includes:
- Guideline: Inspection of empty bulk vessels for export
- Work Instruction: Inspecting empty bulk vessels for export
- Reference: Performance standards for plant export registered establishments
- The previous Guideline: Management of plant export registered establishments was rescinded on 1 January 2022 and has been replaced with a new Departmental Policy: Management of plant export registered establishments. There have been no material changes to obligations or processes.
- There are no changes to Accredited Property instructional material or plant-based oil exporter obligations.
Responsibilities of authorised officers, registered establishments, accredited properties and plant-based oil exporters
- Industry must read the plant export legislation webpage and become familiar with changes to legislation that commenced on 1 January 2022.
- Industry must comply with updated legislation from 1 January 2022.
- AOs who hold the BVI3001: Export inspection of empty bulk vessels job function and registered establishments must comply with updated instructional material from 1 January 2022.

Background
The Plant Rules set the specific requirements for the export of plants and plant products. The Plant Rules are reviewed annually and where needed, amended. On 1 January 2022 amendments to the Plant Rules commenced to align with current business and regulatory practices, and regulatory expectations. This is the first round of amendments since the new plant export legislation commenced on 28 March 2021.
